The App and the Website are referred to collectively as the “Services.” “You” or “User” means the individual accessing or using the Services, and, where the User acts on behalf of a business entity, that entity.
Acceptance of This Policy
PLEASE READ THIS POLICY CAREFULLY. By registering for, creating, or using a Website account or a mobile App account, and by accessing or using the Services, you acknowledge that you have read and understood this Policy and you consent to the collection, use, disclosure, and processing of your information as described herein. If you do not agree with this Policy, you must not create an account and must not access or use the Services.
Your agreement to this Policy is a condition of, and forms part of the terms governing, your use of Website accounts and mobile App accounts. Where required by applicable law, we will obtain your separate, affirmative consent before engaging in any processing for which consent is the required legal basis.
Eligibility
The Services are intended solely for business customers of Power Electronics and their authorized representatives, and for Power Electronics personnel (“Representatives”) who administer customer accounts and support communications. The Services are not directed to and may not be used by children under the age of sixteen (16), and we do not knowingly collect Personal Information from such individuals. If we become aware that we have collected Personal Information from a child in violation of applicable law, we will take reasonable steps to delete it.
1. Definitions
1.1 “Personal Information” means any information that identifies, relates to, describes, or is reasonably capable of being associated with a particular individual.
1.2 “Processing” means any operation performed on Personal Information, including collection, recording, storage, use, disclosure, transmission, and deletion.
1.3 “Service Providers” means third parties that Process Personal Information on our behalf and in accordance with our instructions, as further described in Section 4.
2. Information We Collect
We collect the categories of information described below, whether provided directly by you, generated through your use of the Services, or obtained from our integrated business systems.
2.1 Information You Provide Directly
(a) Account and Profile Information (App and Website), including without limitation: your first and last name; email address; password (which we store solely in salted, hashed form); job title or position; company name; business mailing address (street, city, state or province, postal code, and country); and telephone number.
(b) User Content (primarily the App), including without limitation: the physical locations (“Sites”) you create, together with associated addresses and geographic coordinates; project records; support conversations and messages directed to Power Electronics; files, photographs, and documents you attach to messages; and equipment registrations, including equipment identifiers, serial numbers, and nameplate or serial-number photographs.
© Transactional and Request Information (primarily the Website), including without limitation: saved and requested quotes; sales orders and their attachments; customer-care and return-material authorization (“RMA”) requests, which may include your name, email address, telephone number, company, the purchasing entity, a description of your request, and attachments; and account registration requests, which are retained pending review and approval.
2.2 Information Collected Automatically
(a) Authentication and Session Data, including login timestamps, session identifiers, and one-time verification (“two-factor authentication” or “2FA”) codes used to verify your identity. Verification codes are stored only in hashed form and expire shortly after issuance.
(b) Device Location (App only, subject to your permission), used to assist you in selecting or confirming a Site address. The App does not continuously track your location in the background.
© Push Notification Tokens (App and the Representative-facing Website), used to deliver notifications you have enabled.
(d) Technical and Log Data, including IP address, request metadata, and diagnostic and error logs generated by our servers and infrastructure for security, auditing, and reliability purposes.
2.3 Device Permissions (App)
Subject to your consent, the App may request access to your device’s camera and microphone (to capture media for messages and equipment and to scan barcodes or serial numbers), photo library and files (to attach existing images or documents), and location (to locate or confirm Site addresses). You may grant or revoke these permissions at any time through your device settings; revoking a permission may disable the related features.
3. Purposes and Legal Bases for Processing
We Process your information for the following purposes:
3.1 to establish, administer, and secure your Website and App accounts and to authenticate you, including through two-factor authentication;
3.2 to provide, maintain, and improve the features and functionality of the Services, including Sites, projects, equipment records, support communications, file sharing, quotes, and orders;
3.3 to communicate with you, including the delivery of transactional messages such as verification codes and account notices, and notifications you have enabled;
3.4 to process and fulfill quotes, sales orders, and customer-care or RMA requests;
3.5 to associate your account with your customer record within our business systems for accurate pricing, ordering, support, and account management;
3.6 to protect the security, integrity, and availability of the Services, to detect and prevent fraud or abuse, and to enforce our agreements; and
3.7 to comply with applicable laws, regulations, legal process, and governmental requests.
Where applicable law requires a legal basis for Processing, we rely on one or more of the following: the performance of a contract with you; your consent; our legitimate interests in operating and securing the Services; and compliance with legal obligations. We do not sell your Personal Information, and we do not Process it for third-party advertising.
4. Disclosure of Information
We disclose information only as necessary to operate the Services and as set forth below:
4.1 Within Power Electronics. Your account, Site, project, equipment, and support information is accessible to authorized Representatives for the purpose of providing service and support.
4.2 Legal and Protective Disclosures. We may disclose information where we believe in good faith that disclosure is necessary to comply with applicable law, regulation, or legal process; to respond to lawful requests from public authorities; or to protect the rights, property, or safety of Power Electronics, our customers, our Representatives, or others.
4.3 Business Transfers. In the event of a merger, acquisition, reorganization, financing, or sale of all or a portion of our assets, information may be transferred as part of that transaction, subject to the commitments made in this Policy.
5. International Data Transfers
The Services and our Service Providers may Process and store information in the United States and in other jurisdictions that may have data-protection laws different from those of your jurisdiction. Where required by applicable law, we implement appropriate safeguards for cross-border transfers. This section is pending confirmation of applicable jurisdictions and transfer mechanisms with legal counsel.
6. Data Retention
We retain Personal Information for as long as your account remains active and for such additional period as is necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. In particular:
6.1 Sites and projects are archived rather than permanently deleted upon removal, and associated records (including chats, messages, equipment, and files) are retained to permit restoration and ensure continuity of service;
6.2 verification (2FA) codes are short-lived and are deleted or expire promptly following use (typically within ten (10) minutes); and
6.3 session credentials expire automatically and may be revoked upon sign-out.
You may request deactivation of your account as described in Section 8 and Section 11. Account deactivation disables your ability to log in and access the Services but does not result in permanent erasure of your account record or associated data. We retain account records and associated information following deactivation for as long as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and maintain business continuity.
7. Information Security
We maintain administrative, technical, and physical safeguards designed to protect Personal Information, including: storage of passwords using industry-standard bcrypt hashing; two-factor authentication via single-use, hashed, time-limited codes; signed, revocable session tokens validated on each request; encryption in transit (TLS/HTTPS); and edge protection and rate limiting through Azure Front Door. Notwithstanding these measures, no method of transmission or storage is completely secure, and we cannot and do not guarantee the absolute security of your information.
8. Your Rights and Choices
Subject to and in accordance with applicable law, you may have the right to: (a) access the Personal Information we hold about you; (b) correct inaccurate or incomplete information (much of your profile may be updated directly within the Services); © request deactivation of your account, which will remove your ability to log in and access the Services; note that deactivation does not constitute erasure — your account record and associated data are retained in accordance with Section 6 and applicable law; (d) object to or request restriction of certain Processing; (e) request portability of certain information; and (f) withdraw consent previously given, including for device permissions and notifications, without affecting the lawfulness of Processing carried out prior to withdrawal.
To exercise any of these rights, contact us using the details in Section 11. We will respond within the time and in the manner required by applicable law. We may take reasonable steps to verify your identity before fulfilling a request. Where you reside in a jurisdiction that provides a right to lodge a complaint with a supervisory or data-protection authority, you may do so.
9. Communications
We send transactional communications necessary to operate the Services, including verification codes and account-related notices, which you cannot opt out of while maintaining an active account. Where you have enabled push notifications, you may disable them at any time through your device or browser settings.
10. Changes to This Policy
We may amend this Policy from time to time. We will revise the “Last Updated” date set forth above and, where required by applicable law or where changes are material, provide additional notice. Your continued use of the Services, or your continued maintenance of a Website or App account, following the effective date of any revised Policy constitutes your acceptance of the revised Policy.
